It's not innocuous, that's why it's funny.  Mods are not unfailable and it's clear the way to avoid being banned is by being one of the selected "good ones," instead of anything having to do with the TOS.  That line you trotted out about "i've been banned," is saying you still believe there is an agreement that rulings are based on the TOS and not favor by mods.

And most mods are good because they just shrug their shoulders and move on.  But just look at GAF to see how two bad ones can ruin it all.  Between Beseda's enemy list and Bish's secret ops they created a hellscape of self-pandering groupthink.  There were dozens of mods we here were friends with and they did nothing but shit on NeoGAF and tell us stories about how crazy up their own asses the moderation was.  I see no reason to assume ERA, a site built with the same DNA would be any different.
