Title: Appeal to reduce charges *assistance*
Post by: fistfulofmetal on April 19, 2014, 06:31:10 PM
Hello.

Recently I received a speeding ticket. The other day I received a letter from the procecuter with an option to have the offense reduced however I need to write up the request. I have since put something together.

My problem is that I'm very wordy and I'm worried I'll come off as insincere (because I always sound that way). Can someone read this over and make any suggestions?

First I would like to apologize for my offense and the unneeded work on your part required to handle this matter.

One *date* I received two tickets. The first offense was for an expired car inspection. I will not say this can be excused however I will say the date of the expiration occurred during the same week I moved from Buffalo to Rochester. I can honestly say that during the process of moving I allowed this to slip my mind. I have since renewed my car inspection, of which I passed without issue.

The second offense I have no real explanation for. On the night in question I made a lapse in judgement and as a result endangered myself and everyone else on the road. I sincerely apologize for my error and request that the offense be reduced in both cases.

This would be my first offense against myself and I hope you can show mercy to my appeal (this sounds dumb need something else). As I have mentioned, I do apologize for my offenses and the unneeded work on your part required to handle this. I will work hard to ensure this does not happen again

I'd like to apologize for both the offense and your extra effort in handling this matter.

On (date) I received two tickets. The first was for an expired inspection sticker. The date of the inspection was during the same week I moved from Buffalo to Rochester, and during the moving process I forgot to have this done. I have since had the vehicle inspected, passing the renewal without issue.

As for the second offense, on the night in question I made a regrettable error in judgement. I can ensure this won't happen again, and request that the charge be reduced.

This is my first offense, and I hope that can be taken into account. I do appreciate your time and effort, and thank you for the opportunity.

You can be really succinct about this:

I'm sorry;  do you want a BJ?

The corporate entity known as the State of New York is purely an arbitrary distinction and has no legitimacy as an authority. I do not recognize its authority for requiring inspections, inspections stickers, speed limits, drivers licenses, charges, fines or any other act which is not legitimate when done by an individual. Therefore I either dismiss your gangs charges or alternatively, find your gang in violation of my arbitrary rules to be determined later. I will send an invoice for my services.

Also, I do not recognize the authority of a court that hangs the gold-fringed flag. A flag with gilded edges is the flag of an admirality court. An admirality court signifies a naval court-martial. I cannot be court-martialled twice. That is all.

You left out that your natural rights (which exist because they do) were clearly violated in this encounter.

Dominican record keeping :neogaf

I wouldn't count on that being the case, is all I'm saying. You could get pulled over and find out they have a bench warrant or some shit out for you. Do they have bench warrants down there? Well, they could. Watch out for that shit.

plenty of lawyers out there that will give you a free initial counseling.

i find it easier to pay a little extra and let them deal with it to avoid points and traffic school.

dont just admit guilt. could end up fucking you over. i doubt the prosecutor is trying to "help" you out of the goodness of his heart

Yeah, because prosecutors are known for giving consideration on charges and tickets to people who fight the ticket/charges to the end.  ::)

He's not "helping him out of the goodness of his heart", he's thinking "fuck, my caseload is fucking crazy this month.  What's next?  Another fucking speeding ticket? .....hmm, tell the poor sap that if he pleads guilty and writes some dumb apology letter, I'll knock the fine down by half.  I don't have time to spend a day in court on this petty bullshit."

Also, make note of your sovereignty. :teehee

why would a prosecutor be in the conversation at all unless fistful was trying to fight it to begin with which, no offense ff, doesn't seem like his style.

I'm just saying admitting to guilt right away might take away chances to do driving school and not get points

I'm not trying to fight the ticket. I'm at fault. However, from what I understand, getting a ticket reduced is fairly common. It just depends on the process for that specific court. This court has specifically sent me a document for me to request a reduction of the charge as long as I write out an "explanation". It stands to reason that they really would rather NOT deal with the ticket especially if it's a first time offense.

I've heard other courts have the offender go to court and discuss it with the DA. This court actually has told me they DON'T do that. So the only way for this to be done is via the document I was sent.

Shrug.

Oh it was definitely shitty record keeping or laziness in the cops part, have no idea what a bench warrant is :yeshrug
