The trailer I saw before TFA give the whole plot of the movie away basically and makes the title seem like a bit of a misnomer.

The whole idea of Batman v Superman sounds so goddamned stupid.
And apparently it's a really serious movie with a serious tone.
I mean really. REALLY.
WOW.
A guy who dressed up as a bat, and fucking Superman. In the same movie. And they're fighting each other.
Of course it's going to be a shit film. It's fucking impossible to make anything good with a premise like that.

No it hasn't.
And it all boils down to good writing/film-making. When I look at the trailer, the biggest problem I have with BvS is that it looks like they're trying to shoehorn too much into one movie. You could certainly say that Marvel already has the established characters to build on, but we don't need that with Superman and Batman...it's fucking SUPERMAN AND BATMAN. :lol And this is a sequel to that last Superman movie anyway.
Ditch the Justice League stuff or just make a full-on Justice League movie instead, or take the Marvel approach and (re)introduce the characters in their own movies...then bring them together. It makes more sense.
One thing I think that DC-based live action stuff has over Marvel are the TV shows. I've been watching Arrow and The Flash and they are both awesome. The whole "arrowverse" thing has done an amazing job of establishing characters and bringing super-powered characters to life as well. The shows are way more exciting compared to Agents Of SHIELD. And yet Warner Bros. is NOT using these actors on the big screen and they're not linking all their shows together. Why is Supergirl not part of the arrowverse? I can understand Gotham not being part of it, at least.

It's not even the fact that they *tried* to build it up is its a really shallow reason for what will be a massive divide. In the comics it works because its much more of this policy/civil rights issue and Captain is vehemently against it. He cannot in good conscience, especially after WII side with Cap/Govt. He's not just riding for a homie then being like "yo this bill is bs lol nah." Stark becomes a symbol for a lot of things he became the soldier he did to fight against.
To another side of the cake as to why this shit doesn't really work in the MCU, because of how grounded and semi-realistic it tries to be at least organization wise. So if MCU is reflecting a world closer to our own, and we live in a world of impricse drone strikes that create massive collateral damage and bad intelligence leading to bad operations why wouldn't you want people who could fly and destroy cities to have a lot of oversight?

Iron almost dies and almost fails to stop a catastrophe and realizes how fragile he is and how heros aren't enough to insure the protection of people, thus he tries to create ultron. Ultron is a total mess, mostly because he tried to do it on his own instead of trusting people and organizations, like shield.
Cap on the other hand discovers hydra is in shield and takes the opposite view that heros need to be the ones safe guarding people not organizations.
At the same both heros and super villains have been doing some pretty massive damage and so now that it is time to take responsibility for this and insure it doesn't happen again, you have these two on different sides of how to handle it.

I was going to post about how im debating comic book movies on new years while I eat microwave burritos and watch all the nicely dressed ladies pass by my window, but putting it into words hurts too much, so I'm glad I didn't.

I'm not seeing it. The big divide in the movie is over Bucky, is it not? The Hydra stuff isn't part of this.
