A judge has cleared the way for the parents of a 21-year-old West Point cadet fatally injured in a skiing accident to use his frozen sperm to produce a child.
Supreme Court Justice John Colangelo says in a decision dated Thursday the parents of Peter Zhu haven't decided whether to attempt conception with a surrogate mother. But he ruled it's their decision to make.
Zhu, of Concord, California, died after a ski accident in February at West Point. His parents received court permission to have his sperm retrieved and frozen , but the judge waited until last week to rule on whether they could attempt reproduction.
Colangelo said he found no restrictions in state or federal law. But he noted other obstacles including reluctance of some doctors to assist for ethical reasons.

Maybe I read Antigone too many times in high school and college but unless the deceased specified that he wanted this in his will it comes off as grotesque, like burying (or not burying) someone not in accordance with their last wishes.
The story is a bit sparse but as best I can tell it's not like he exactly had a certificate of deposit at the sperm bank. If he did then you could rationalize this on the grounds that he'd already conceded that he wanted kids but wasn't sure of the timeline.

Zhu left no written intention regarding the use of his genetic material for procreation after his death, Colangelo said. But he said Zhu’s parents testified regarding conversations where he talked of his dream of having several children and the responsibility he felt to carry on his cultural and family legacy. Zhu’s military advisor at West Point also testified that Zhu had stated a goal of having several children during mentoring sessions.
Sounds like the kid wanted it too, or they are just lying through their teeth to the court to get their sticky little hands on the son's jizz.

At first I thought the kid had already frozen his sperm for some reason while alive and I was like "okay I guess the parents can inherit the sperm and do whatever with it but that's a little weird damn" but then I read on and ummm... yeah what Transhuman said about the cattle prod :doge :doge :doge
I know my parents are disappointed in me for not having kids, should I make a will saying "DON'T RAPE MY DEAD CORPSE" in case I die and they feel like having a baby made from corpse cells would be a really swell way to remember me by :doge
