ELSPA has claimed that 90 per cent of all DS users in North America are playing pirated games via the notorious R4 cartridge.

John Hillier, manager of ELSPA's Intellectual Property Crime Unit, said that the R4 – a cartridge that plays hacked games downloaded onto a memory card – is harming sales for Nintendo and making it the least-profitable console on the market.

"The implications are massive. In America it's thought 90 per cent of Nintendo DS users are playing pirated games because of R4s," said Hillier, talking to The Sunday Post.

"Takings from Nintendo DS games in the US are lower than any other console and no doubt it will have a similar impact here," he said, discussing the uptake of the R4 in the UK.

The R4 is available to buy over the internet and unlike previous chips and modifications for other consoles, requires no clumsy hardware modifications.

The biggest threat that the R4 makes to the piracy problem, according to Hillier, is that it allows users the freedom to download hacked games from their PC and import them straight to the handheld.

"That's the real danger – you may think you're getting a good deal but using the R4 is risking the future of the games industry."

"Crucially, the R4 has shifted balance of power in the piracy industry to the consumer – and that is hugely worrying," he said.

DS library has had a bit of a mistep since fall of last year. Back then I couldnt keep up with the DS releases.

Truth be told the PSP hasnt offered a whole lot of PSP games since then either.

The majority of Nintendo's DS Lite demographic is the casual non-gamer, who barely know how to enter the directions to GameStop into their TomTom and buy Brain Age 2, well enough order a flash cart from the Internet.  What kills DS software sales is that those folks won't buy crap like Contra and Etrian Oddysey, because they don't even know what they are and the demographic most likely to buy said titles will buy a R4 cart.

The PSP on the other hand is just a crazy piracy device, at this point.  I would speculate that the majority of folks who purchase one from my store, do so with the sole intention of hacking it.  Would I dare say some ludicrous number like 90%?  Nope, but more than half, for sure.

it's hard to finish pirated games becuz u didn't pay for em

back when i was petitioning for ff4 and ct to be released stateside for the psx I dled the roms and I couldn't finish them because it just felt wrong for some reason

and i didn't really get to play em until they released them as final fantasy chronicles

I can't troll you about the music industry thing because I essentially agree with you that the RIAA fucking sucks.  I honestly can't blame you for pirating music when the recording industry eats up all the money and the artist gets pennies.

Also, the "review copy" of Mazes of Fate DS I have is in fact, a flash cart itself. So it's not just regular people who are using flash carts.
