No knock warrants redux

Summary: cops come crawling through the window, possibly did not identify themselves, or the resident did not hear them if they did. Man fires on who he thinks are intruders attempting a home invasion.  One cop is killed. Man is charged with capital murder. Texas is seeking the death penalty. No drugs were found. Warrant was based on a bogus tip from an "informant".

Are we still in favor of this crap in most of the situations it's being used in? These guys deployed an early morning raid against a private citizen with no violent record based on a single tip. Shit like this is just too risky, and in most cases it's not worth the risk. It also fundamentally conflicts with our American cultural heritage of freedom and the right to self defense. The 2nd Amendment, Castle Doctrine, and these raids make for a horrible combination. And it's becoming clear that police do not always make their identities clearly known, despite what any no knock apologists would argue.

It's also crystal fucking clear that this man should not be charged with a crime.

Here's what really gets me: the NRA and right wing media have relentlessly played up the image of the strong American homeowner defending life, family, and property against the forces of evil that are lurking just outside. They are directly feeding into the mentality that you need to shoot first at whatever comes through the door and worry about who it is later, when you know for certain that you're safe. And that is EXACTLY what this guy did.

If you're not always armed and always ready to fire at moment's notice, you're a victim waiting to happen. Unfortunately for this guy, the person he happened to exercise his constitutional rights against was a cop.

(1) knew or had reason to believe that the person against whom the force was used:

(A) unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment

Case closed. Not guilty.

I'm kinda baffled at how many people in the GAF thread are indicating they didn't know that no-knock raids/warrants were even a thing.

They probably don't even know about the no rights hundred mile border zone either!

There's no problem with Boogie or other officers giving a professional perspective based on experience, the problem is when they deny the double standards/twist logic into knots to justify crimes/say it's just a few bad apples/etc.

Boogie for the most part does not that do that. And I think he's opined before on the counterproductive methods like this.
