Beyond Kavanaugh's entire diatribe and the allegations toward him, his actual record is horrifying and this presents a horrific situation for many of this countries individual liberties.

As much as I hate it, I might vote Beto next month. Democrats need more firepower in the Senate to stop awful situations like this.

I’m not really hating on Manchin for this. Manchin votes no, and he still gets confirmed with Pence. I’m sure that’s part of the political calculus he did.

I have trouble understanding this perspective but I  would probably be as depressed as you are if the most significant forces in this country were undemocratically elected lifetime magistrates. Court cases are rarely overturned and judges are not legislators with political agendas (although I think Kavanaugh isn't impartial). The most significant decisions, politically, still hinge on technical details and good faith interpretations of the law. Think Justice Robert's majority decision on the ACA.

Roe v. Wade is settled. What's up to interpretation is how far states can go to make an abortion difficult or long it remains a legal option for the mother, but abortion will never be illegal in this country, ever, and even if it is it won't be because of some guy whose best friend was named Squee in highschool. It'll be because of some kind of second great awakening and widespread abandonment of modern, liberal human rights, at which point you have more problems than the courts.

Are you stupid? Don't answer that. Every major supreme court decision this year was a 5-4 split in favor of conservatives that gutted labor rights and minority rights. Overturning prior horrible decisions like the ones he cited would be fucking wonderful and indicative of a principled and literate character predominating on the court.  It would be *ideal.*

TBH, I feel like the supreme court shouldn't wield this much power. When both sides are trying to push their own agenda trojan horses into the mix, something is very, very wrong. The fact that Republicans think,"we can use Kavanaugh to turn around Roe v Wade" or whatever and the fact that Democrats fear that would happen is ridiculous. This calls for an endless game of replacing justices every few decades at the perils of generations that potentially don't even agree with them politically. Most American's support abortion in some form, for instance. Yet we have justices that are clearly anti-abortion that represent religions that want to make it illegal. The court wields too much power, is used overwhelmingly for partisan interests rather than those of the American people.

It was basically designed to be the branch of government over which the public had the least leverage, hence lifetime appointments.

My rather uncooked opinion is that the issues with the court are mostly metastases of our generally fucked up political situation, rather than something unique to the institution.

You should watch the entire Hyper-normalization doc by Adam Curtis if you have the chance.
Some eye opening stuff. Especially because it aired right before the 2016 election and if you had seen it you couldn't be more certain of the outcome.

I think a lot of people are unwilling to tolerate others expressing their Schadenfreude as this was actually expected to happen unlike Trump winning the election, specially since how vile the confirmation process has been.
