Smart enough or skilled enough to what?  There are no unions because Wal-Mart won't let any form.  Wal-Mart also has some ridiculously high year-over-year turnover rate, like 70-80%.

The Walmart near the university I attended unionized. Walmart simply closed to the store down, fired everyone, and built a new store near by. That, along with the high turnover, is why employees do not bother to unionize. Blue collar workers may not be 'smart enough or skilled enough' to direct movies about talking piñatas, but they work hard doing shit jobs and deserve to be fairly compensated. They would gladly unionize if they thought it wasn't a futile endeavour. 

Anyway, why would Walmart care if they received an image boost? The people who would be impressed would likely never step inside the store even if they were giving away Che Guevara hemp t-shirts. Meanwhile, the people who do shop there would be pissed that they had to pay two extra cents to shop at the now unionized store.

Wal-Mart rewards managers for shutting down potential union starters, so it's nigh impossible to get an entire store behind the concept, and when they do, Wal-Mart just shuts down the store and fires everybody.  And then usually opens up a new one with veteran management staff.

Can, Could and Would. Also, that kind of mammoth organizational capacity for a workforce that has a 70% turnover rate would be impossible for any kind of grass roots unionization campaign.

I really think Wal-mart is the new K-mart. Both started off with incredible sales and expanded to all of America, but both underpaid their workers and delivered barely adequete goods. Eventually, your middle class American catches on and shops at newer/better stores (Costco, Target, Kohl's) and all Wal-mart is left with are the very poor shopper. Bad image for the store means less competent applicants .. which means worse customer service and more theft. A downward spiral that never corrects itself because the core of your business model is rotten.

K-mart of course is in its death throes ... Wal-mart's vast money will help it survive much longer .. but you can already see the frayed edges.

no it's not illegal, but the employer's pressures are too strong to overcome for all the poor workers

if you watch the documentary "Wal-Mart, the cost of low prices", it shows how Wal-Mart monitors all of its stores for potential rises in syndical activity, and then when it happens the headquarters are IMMEDIATELY warned to allow them to devise a strategy of counter-attack

One problem is that managers at wal-mart and fast food try to prevent anybody from working 40 hours a week, that means having tons of different people working there (and they definitely have enough applicants) but still making them as understaffed as possible to minimize the amount of money paid in wages.  Companies have a lot of possible ways to pay people who do actual jobs for them so they look for ways to avoid paying them.

If you tried to unionize, they would send a special task force by private jet and they would set up cameras and monitor everything from a van in the parking lot plus interview everybody.  Any intention of a union is made anonymously.  It's legal to fire somebody in the U.S. for that since there are wal-mart unions in germany.  Plus wal-mart and fast food franchises are the types of business you can put anywhere and they're so common that it won't make a big impact on profit in an area if you closed one down for a while and opened one in the area later.

Normally when people see a company sucking the blood out of a country, they research it.  You didn't.
