Borked X360 DRM : can someone explain it?

a few people i know have recently went on a "broked X360 DRM" rampage following getting their RROD machines back and frankly i'm confused to what the issue is - can someone please help?

Now, before we start - i'm SURE there is an issue, but i'm just too pigshit thick to understand what it is - so i'm not trying to palm this off as "ooo MS don't make mistakes" - but what i can sort of fathom is :

1) they had an X360
2) the X360 then died
3) the replacement X360 came back
4) the content was gone
5) somehow they couldn't play the games they bought

I'm baffled i guess because i've played live games i own on 4 seperate X360 consoles without replaying each time, simply by slotting a mem card into the slot.

So i'm confused as to what is the issue? if you get a new/refurbed X360 back, isn't the option to recover your tag always there? isn't the purchase data stored server side?

what am i missing ?

isn't this what happens though? you don't have to be signed into XBL online AT ALL. As long as you have a valid profile that you can sign into ONCE on whatever machine (EASIER WITH A MEM CARD) then that's it right?

sorry, i just feel like i'm a moron missing something - it is a shitty set up but hey...

yeah, I don't know either--I transfered my profile to a mem card before I swapped out my 360 and then transferred it back and redownloaded all my games

I also called MS and confirmed this would work before doing so

I haven't had any issues. maybe if I'm not signed in, it would be broken, which would suck, but since when am I not signed in?

the setup is simple.

as long as you are online, you can play whatever games you bought on whatever console.

you don't need to be online to play them if you are using your own console. (the original console you bought these games on)
 
there may be some sort of fucked up cases i don't know of, and frankly i don't wanna know, this drm is real headache.

I'm thinking if your internet goes down or your live subscription lapses, you can't play the games.

But that would be merely a guess.
