I had two MIPs before I even 18. for the first one I hired a lawyer and I was forced to pay a fine as well as attend an alcohol "class" with my parents (I was only 16 at the time). For my second one I did not hire a lawyer and I was forced to pay a fine, perform community service, and attend another alcohol class. The second one stayed on my record and was only expunged last April. All in all, I would say my first MIP totalled about $1,400 total in costs and my second about $1,000, with the difference mostly due to lawyer fees. I would definitely recommend a lawyer if you can afford it though, because he/she may be able to keep the charge off your record, which is definitely worth it. All of this happened back in 2000 and 2001.

Anyways, my halloween was shitty because I had a fatigue induced headache that felt like a mild migraine. My wife and I went to a party at our friends house which was fun, but would have been much better had it not been for the headache.

I live in Michigan and all of that happened awhile ago, so your miles may vary. If you have a clean record and even good grades, the judge will be more likely to go easy on you (at least it was in my case). As for the money thing, I am pretty sure arrangements can be made with the court, or you might be able to serve more community service in exchange for the fine.

My second MIP was absolutely nuts. We were partying at a friends' grandparents house who were out of town. The neighbors, who were asked to watch the house while the grandparents were out of town, alerted the cops to a break in. So several K-9 units show up and the cops are chasing dozens of kids through the woods. My friends and I, about 5 of us, ditch in a basement room that is connected to the garage (the room had windows so we could see everyone getting arrested.....lulz). We were able to hide in their for 4 hours before one of the cops opens the door and gives us all breathalyzers. Once they saw I was over the limit, they called the my parents (easily the worst part) to come pick me up. When my parents arrived, the cops tried to scare my parents by saying that all of us could be charged with breaking and entering in addition to MIP. Stupid fuckers (They would have had to charge their own grandchildren in order to charge all of us with b&e, but of course my parents ate it up).

It's kind of ridiculous, to tell you the truth. I realize that it is against the law for minors to drink, but is it really necessary for cops to be assigned to catching kids? Or, in my case, for fucking police dogs to be dispatched and chase kids down? As an adult, I would much rather police spend their time pulling over drunk drivers, or even shitty drivers in general regardless of age. I could give a shit less about underage kids drinking if they aren't hurting anyone else.

I think it's ideal to catch someone whose running from it and if they had weapons, but don't fuck them over if they're just outside walking and drunk.

I wasn't even that drunk. I was totally aware where I was.

Some kid got bite by the dog across the street. I heard the bark, then the scream, then the frantic yell of a parent.

All the while my dogs slept quietly in the house with all the lights off.

I lost an arranged ride home at a party because I had to get up to go vote early, and I told my driver I was voting for Obama in casual conversation. She refused to take me home because I wasn't voting for McCain.

True story.

I was drunk, so I informed her that she was un-American because she was depriving me of my right to vote.

I ended up having to get a friend of mine to pick me up at 5 AM from 15 miles away.

I did get to vote. Bitch.

I wonder if the state could've pressed charges upon the grandkids and on all of you regardless of what the grandparents say.  Were the grandkids supposed to be there at all?  I bet the grandparents would just say kids were house sitting or something to cover their grandchildren's ass, but I wonder what would happen if they didn't.   But maybe it'd just be a waste of money for the state to press charges... the DA would be like, "why is this shit on my desk?"

Yo, read this very carefully:

Get a lawyer.

This is what's going to happen. Your possession charge is going to cost you about $1,000. Maybe a little more. The only question is, do you give that $1,000 to a lawyer and walk away with no record and no community service, or do you give it to the court and your probation officer.

I have been in this situation before. If you don't get a lawyer, you are going to get a public defender. If you get a public defender, the judge is going to slap you with a $250-$500 fine, then you're going to pay $50 a month to a probation officer for a year. Maybe more if they make you take alcohol abuse classes.

But, you go get a lawyer, the man makes it go away. That's what they do with this petty shit. The lawyer is buds with the prosecutors and the judges. Your case will be over before it even begins. You'll walk in, get a PBJ, and walk out. If you're lucky, you won't even have it put on your record.

Get a lawyer. I cannot emphasize that enough.

Dude, your fines are going to cost too. And in answer to your question earlier, you pay fines immediately, as in the day of trial. They will let you leave the court to hit an ATM or whatever, but the court isn't about to give you a payment plan.

A lawyer, which DOES cost, at least can be negotiated with, and paid in installments.

Bottom line: you are paying either way.

Little personal anecdote: When I was in college, around 20, I was arrested for possession of alcohol and for drinking in public. I was having a beer in someone's front yard. I went with the public defender. Got slapped with 2x $250 fines, $50 a month in probation costs for a year, and had the convictions placed on my personal record.

Fast forward to last year. I had an interview for a job. Did very well, was told I had the job, but had to submit to drug and background testing. Passed the drug test, failed the background check because of the open container and underage possession convictions. This is 7 fucking years later, and that shit is still kicking around my personal record, fucking with my life. Now, thankfully, my future (or I guess current) boss went to bat for me, and got corporate to make an exception. But if he hadn't, I would have missed out on a great oppurtunity because of some silly shit almost a decade ago.

I am going to get those charges expunged as soon as I can. This will probably cost me many hundreds of dollars, but it will be worth it.

Anyway, that's my story, and that's where I'm coming from. A lawyer has a very good chance of getting you out of court with no convictions and no fines. A public defender has basically no chance. You pay now either way, and if you get slapped with fines and a conviction, you pay later.

Yes, you can probably expect to drop something like a grand. But call around. I know it sounds skeevy, but ask friends and relatives for references. See if anyone you know has had positive experiences with a firm in the past.

+1 to the lawyer idea. My lawyer fee was $550 and I got my fines dropped to half of what they would be.

As for my Halloween, we took a troop of 7 out for about an hour. Came home, ate, watched 5 kids fight over 3 controllers to play LBP. They picked up on it pretty quick to my surprise.

$1000?  What the fuck?

When I got my MIP, I took a two day class (had pizza) and paid $40 in legal fees.  After passing the course, the MIP charge was removed from my record.

I have a bunch of friends here who have gotten MIPs, and it was basically like a slap on the wrist. Employers, don't really care, either, it seems... "Minor in possession of alcohol" is probably one of the most bullshit charges ever.

Also, I don't know where those $1,000 figures are coming in. I had one last year, but I got it dropped

wtf - for having a beer ? why am i constantly baffled by how ass backwards america has their values.

shit like that should not be going on your record - in the uk you wipe the slate clean of minor offenses at 18 so your life isn't totally fucked., but that also happily coincides with us being able to drink our asses off at 18 legally.

Whats the $500 for then?
They will basically take anything you have for bail. They don't expect people to carry $500 cash. I'm sure they would ask a lot more questions if you had $500 on you. It's bail. You get it back when you show up for court.

I spent most of Halloween playing Fallout 3. That's pretty much it, really.
Probably the better plan.

Before I call the court, I figured i'd ask you guys since you've all been a great help so far:

Can I pay a fine to get out of court, or do I absolutely have to go? Also would calling the court now without a lawyer to ask if I can just pay the fine or whatever be worse?

IN the US, you can mail your ticket in as an automatic guilty plea.

That depends on where you are, what kind of ticket it is, and whether or not the police officer checked the "court appearance mandatory" box.
