You know what's really lame? When folks decide on a sample, then can't get it cleared, then decide to get session musicians etc. to just play something similar. When you know what it should sound like, it can be horrible to listen to. Like in commercials where they get musicians to play something approximating the Rocky theme. You can tell what it's supposed to be, it just sucks.
For example, the Fun Lovin' Criminals have a song on their 1st album that was supposed to sample 'Smoke on the Water'. Instead, they just have some random power chords played on a very generic-sounding guitar set-up rather than Ritchie's classic Strat + Marshall rig.
So yeah, i'd rather they just went ahead and used the damn sample. More possibilities can only result in more creativity. Uncreative artists won't be any more or less creative whether they use samples or not, but the imaginative folks can only benefit from it.
