i'm missing something in these articles. EFF is bringing a filing to prevent something that, to date, hasn't happened.

It seems to be arguing that Apple COULD sue/see jailtime, but i don't see anywhere where Apple have said that's what they are going to actively persue that. All i see is what they can do right now if they wanted to force the matter.

Apple may not be actively pursuing it, but they reserve the right to under the DMCA. EFF is asking the government for an exemption to make it legal, and Apple is saying NUH-UH.
