SAN FRANCISCO — These are heady times for advocates of legalized marijuana in California — and only in small part because of the newly relaxed approach of the federal government toward medical marijuana.

State lawmakers are holding a hearing on Wednesday on the effects of a bill that would legalize, tax and regulate the drug — in what would be the first such law in the United States. Tax officials estimate the legislation could bring the struggling state about $1.4 billion a year, and though the bill’s fate in the Legislature is uncertain, Gov. Arnold Schwarzenegger, a Republican, has indicated he would be open to a “robust debate” on the issue.

It's the supremacy clause in the constitution.  It means that federal law supersedes state law.  So in this case, yes.

I rarely smoke weed now. But weed being illegal really confuses me. The drug isn't bad if you smoke it from time to time.

The drug should be legal. Legal drugs like coffee, cigarettes, sugar etc are more dangerous than weed.

You want to know how fucking stupid the stoners are in CA? There are TWO IDENTICAL ballot measures to legalize pot and they are named "Legalize, Regulate, and Tax Marijuana" and "Legalize Marijuana and Allow It to Be Regulated and Taxed".

They are the EXACT SAME FUCKING THING. You'd think they'd, you know, talk to each other before putting two identical measures on the ballot to confuse people.

They aren't identical. For starters, one would allow state taxation and the other (most likely to end up on the ballot) would only allow taxation by cities and counties.
