Eh I'm not bothering at this point. My husband is on my life insurance policy and my mom is secondary. I'd be more concerned with who's getting the dogs if my husband and I are both taken out. Both of our families are capable of raising our child, but the shibas are smarter than basically anyone we know. They sense the ability to run away and they're gone. They know we know what they're up to, so they don't try shit with us.

We've gone on 1 long weekend trip since we've had the dogs, and they ran away. We took them on our honeymoon for this very reason. Also, because we would've come home after a few days if we left them.   :-[

Little bit of advice from someone who worked for a life insurance firm: It's utterly pointless getting a life insurance policy before you have a kid really, unless your significant other is incapable of fending for themselves. Such a scam. Even then, you only need it until the kid reaches adulthood. No point paying premiums to benefit a kid who is 30, in most cases. In any other circumstance, you are better giving the money directly to the kid in the form of an inter vivo or similar, or just using it to care for them (including college and so forth)

Anyway, you don't need a will kit.  Just type something up and sign it in the presence of 3 uninterested witnesses (people who you aren't leaving stuff to) and have them write and sign that they saw you sign and each other sign.  I can give you a form for them to sign at the end of whatever you write.  Then put it somewhere safe. 

If you want to destroy it then rip it up or burn it or make a new one which automatically overwrites the old one.

But yeah, do a trust instead.  It'll cost a little money but whoever you leave stuff to will appreciate not having to go through probate court.

Probate = when you die, if you have over x amount of $$$ total, the people you leave stuff to have to go to the court and have the court oversee the process which means you pay a probate lawyer a % of the assets and it takes months and months.

With a trust it's just like a corporation and your the CEO of MAF CORP.  When you die the corporation remains and the VP takes over the reigns.  No court stuff necessary so it saves money and time.

When my father died in New Mexico it was so simple.  I called the local probate judge (on her cell phone haha) and asked for advice.  She told me that if my dad had a will we could sort it all out ourselves but since he didn't we needed to go fill out probate paperwork and she would approve it and make me head of his estate and I could then take care of it how I wanted to.  So I filled out some paperwork that included his assets, debts, etc.  Got my brothers and sister to sign it and then I took it to the judge.  She had it signed the next day.  I picked it up and then had it notarized and all I had to do was go to his banks and show them the paperwork and I had access to all his accounts.

It does differ from state to state, but generally probate is slow and if the estate assets are over a certain amount (differs by state) there are a lot of costs associated with it, which is why people form trusts.

Yeah I looked into this with a probate lawyer, since I do wills & trusts and estate planning which is a separate field than probate.  Apparently in CA almost no one does probate stuff on their own because there's a ton of forms you need to fill out, file with the court, and give proper notice to anyone involved.  New Mexico is probably a lot more lax on their forms for probate.  If someone hires an attorney in CA to do the probate stuff, they can charge up to a maximum of 3% of the total worth of the estate they are probating.  So if it's a small estate like 50k, it's not much money ($1500), whereas if it's a million bucks that's $30,000 just for some forms to be filled out; which is why people tend to want to avoid probate.  A trust typically costs like $1500 to setup regardless of if the estate is worth $25,000 or 25 billion.

Also some people just don't want to deal with the court system at all.  Having a trust lets people avoid filing anything.  You just take the trust document to the banks, dmv, etc... and show it to them and they move the stuff into the beneficiaries name.  It's pretty quick and easy.


I don't have a will or a trust because I own nothing of value besides my ultimate game & :uguu collection.  At some point I'm thinking about making one giving all my games to a Japanese kids charity (because 95% of my games are in Japanese so white kids would be emotionally scarred by the wacky jappy).  If/When I pay off my mortgage for my Condo I'll have to figure out where I want that to go.

Possibly unrelated, the ONLY good thing in The Mechanic remake was Statham choking a victim to death, then using autoerotic asphyxiation as an apparent accidental death so there'd be less investigation. Poor Michael Hutchens and David Carradine -- they just KNEW TOO MUCH!

You don't need to file or notarize a will.  This seems like a decent list:

Note there are two main kinds of wills:  Formal Wills, which everyone will recognize as being legit.  These are usually typed, include some language at the start and are witnessed and signed by witnesses (2 or 3 depending on the state).  And holographic which are me writing "I GIVE MY PIMP MOBILE TO JIMMY" on the back of a condom.  In a lot of places, that's just as legit as going through all the legal hoops to make a nice looking formal one.  CA recognizes holographic wills for instance, but not every state does, so it's usually best to just do a formal will.

Honestly, probably would take you like 30 mins to write a formal one if you know what you want to do with your stuff.
