I don't really have a stake in this at all, but I REALLY don't like the treatment of footage of a game being played as something owned by anyone but the person playing it.

I feel absurdity of this situation is analogous to BMX claiming ownership of any footage involving someone riding one of their bikes (or for the more bogus claims, the company that produces the tires for bmx bikes issuing the claim).  Or wizards of the coast issuing takedowns on videos of someone's D&D campaign.

Hopefully all of this mess comes back to bite every single one of these companies in the ass, and hard.

Edit:
Just saw mandoric's post after I posted this.  His thoughts mirror my own.

I disagree about AAA, this won't shut them down. I'm sure they'll simply respond by releasing their own videos of people playing AAA titles.

He didn't say it'll shut them down. He said it'd hasten that.

http://www.giantbomb.com/articles/the-youtube-snake-is-eating-itself/1100-4815/

From the story:
Quote
Magnus Pålsson @MPSouleye
I'm getting copyright infringement notifications on my own music on youtube.

The company that does the "publishing" of his music responds:
Quote
TuneCore         ✔ @TuneCore
@_Branislav_ @MPSouleye Claims are placed on the music for you, Magnus. All our publishing admin customers collect revenue from YouTube...

Quote
Magnus Pålsson
@TuneCore @_Branislav_ Done. How can I stop my employers from getting flagged? And what about letsplays of games etc? I'm a game musician!
@TuneCore @_Branislav_ Ok. Now, how to help lets-players and reviewers of the games I made music for? They're many and I don't know them.

So they respond:
Quote
TuneCore
@MPSouleye @_Branislav_ ...don't know them, how could you give them permission to use your music? It's claimed for you, since you wrote it.
:lol

And he can't have them not do the IDs of his work without opting out of the entire publishing service.

There's only one possible solution to all of this... PirateBay needs to open a streaming service.

I was thinking about this a lot, and in a way, I can kind of understand the angle of the games companies from the point of view that people doing let's play type vids are 'giving away' or 'letting people experience' the content they spent lots of money to produce, program, etc for 'free'. I mean this isnt like back in the days during the christmas break when we would invite a couple of friends and marathon thru Dragon Warrior on the nes; far more people are getting free rides here..

This is just an exemple, I remember a rant on twitter or maybe in an interview from Ed Boon where he was talking about how sad he was that all the fatalities and secrets of his latest MK game were available on youtube the day before the official street date.

It kinda sucks!

I think the problem Shuri is that the developers and publishers for the most part do not have problems with Let's Plays and whatnot. You can just look at how many are coming out to say they're fine with it and are helping the Youtube people get their claims disputed.

The majority of the time these claims are coming from third parties to the third parties for things like, a piece of audio from a section of a game or a song that was licensed out after the game came out. Stuff like that is why people are pissed at Youtube right now.

Oh yeah, I saw all those corny animations, no need to buy that game any more. What? :heh

I don't think what Boon said there has anything to do with this. He obviously laments the leak and probably just misses the arcade culture where someone pulling off a fatality or showing you something you had never seen before was an event. That's fair, but - the times, they are a-changin'. That sort of stuff can't be a pull any more. Who'd buy a game just to see the new round of gory executions? How many, rather. I doubt it's a significant number.

With Let's Plays it depends on the game. I don't hate "non-games" (quite liked Dear Esther for what it was), but those are the only one that I would say need to be seriously worried about videos. I doubt developers of "gamey-games" are worried about video play-throughs cannibalizing their sales. Publishers maybe, but I'd expect the actual developers to be aware of the irony there.

Boon is generally very nostalgic for the chinese telephone rumor mill surrounding his games. When they did the second PS2 game they put a bunch of incredibly obtuse shit in the adventure mode and it was all common knowledge a week after release because someone dumped the info and wrote a faq. I think they kinda gave up on that front after that.

The days of Ermac are behind us, brehs.

Well this is somehow working out for me, because I've had 0 copyright claims and my viewership is up to the point that YouTube's gonna pay my rent this month.  :usavich

If your game can be fully experienced by watching a video of it there is something wrong with your game.
