He is near death, and it was all my fault.  I thought maybe the Chameleon disguise thing would prevent the enemy from raising exclamation marks, but I killed him!  I killed him! :'( :'(

Yes, but it's really risky. I think 2.71 is the only "safe" firmware, anything above you have to go the GTA LCS route, which is a more safer route.

Is there any way to tell at-a-glance if a particular copy of LCS is good to go?

Not really. Ask if you can try the game in your PSP at the store. New copies are patched, you are gonna have to go used.
