Can I take legal action in this situation?
« on: December 07, 2008, 01:52:58 PM »
Long story short, I quit my job yesterday. Because my manager is an immature fucking prick who needs to get his ass kicked into the stratosphere.

I worked from 9AM to 4PM yesterday (Saturday). I've been meaning to quit for a while as I've already applied to several other jobs, but I was simply fed up with that fucking asshole who is somehow my manager.

I quit yesterday, but I didn't just storm out. I waited till my work day was over, and at the end of the day I waited until my boss (not my manager; my boss seems like a mature, level-headed guy) came back. I told him in a respectful manner that I quit, and he said it was fine and that I "gotta do what I gotta do".

I see my manager today (he goes to my church) and before he walks out, I remind him that I worked 7 hours yesterday (9AM-4PM) and I should get a 50$ paycheck next week for the hours I worked*. I could tell by the tone of his voice and his "whatever" attitude that he plans on 1 of two things.

1. Lying about my hours to my boss and giving me a less-than-50$ paycheck.
2. Not giving me my paycheck at all, either because he lied to my boss or because he cashed it in himself and took my money.

Can I take legal action if this happens? I have a serious, serious feeling that he is going to lie and not give me my paycheck at all, regardless of taking 7 HOURS out of my day to work. He's an immature, childish, motherfucking cuntface like that. There are many stories I could tell behind his actions but that's digression. Oh, and he always, always, ALWAYS bends stories in his favor. Always. He's a goddamn liar and if I don't get my paycheck he can kiss his gonads goodbye.

*I got paid 8$ an hour. 8x7 = 56. Taking off tax, it'll be a 50$ paycheck. I've gotten a 7 hour paycheck before, it was almost exactly 50$ [I only worked 1 day that week due to complications]. So I know exactly how much I should get on my next paycheck... IF I get it.

So. Can I take legal action if I don't get the money I earned?

you could maybe take him to small claims court, but $50 might be too small even for small claims court

I would complain either to your union or to your state/county's employee development department if they don't give you shit.

He's probably saying whatever because you quit out of the blue (for him), and now the first thing you say to him is about money.

He's probably bummed out that he has to replace you all of the sudden. Managers are people too. ;)

Legal action over $50 doesn't sound like it would work so well.

All he ever talked about was how worthless I am (he "joked" about it, but he did it ALL THE FUCKING TIME, and it got damn old). Then when I told him I couldn't work, he would PLEAD to me on how he "needed" me.

He would also kick me, punch me, and when I got stuck in the mud so many times, he would throw away my shovel so I couldn't dig myself out. Granted, he was "joking" with all of these abuses, but it was fucking childish and hardly productive at all for the job.

Maybe. But I certainly did not take 7 hours out of my day to work for NOTHING. I have finals next week, I could have been studying. If I don't get the money I earned I will be more than livid.

you could if you have evidence that you worked, like a timecard and people to vouch for you (though people still working there would probably not want to risk it for your $50.)  On the other hand, you'll be in the negatives after all is said and done, whether your case goes anywhere or not.  there's a chance the judge will reprimand you for wasting his time over $50.

I wonder if they even have timecards at the mud farm.

When I was a kid I loved walking in deep mud that goes up to your knees or waist.

Dunno if I'd want to do it for a living though.
