The former editor, Albert J. Daulerio, a defendant in an invasion-of-privacy lawsuit brought by the retired wrestler Hulk Hogan, made the comment under questioning by a plaintiff’s lawyer, who had asked him where he drew the line when it came to posting videos of people having sex.

“Can you imagine a situation where a celebrity sex tape would not be newsworthy?” asked the lawyer, Douglas E. Mirell.

“If they were a child,” Mr. Daulerio replied.

“Under what age?” the lawyer pressed.

“Four.”

Probably was paid hourly if Hulk was smart and could afford $100,000 in attorney fees for a big case like this with a good firm. If Hulk was dumb and went contingency, and it went to trial, probably 25-40% depending on if Hulk bargained.

I'm not sure what fucked over Gawker more. The fact that Hulk's lawyers were on point and had everything including showing every instance that Gawker Media created an article that campaigned against "Revenge Porn" and detailed Gawker's own stance on "Revenge Porn" once one of Gawker's editors were pressured into bringing it up they didn't consider the Hulk tape "Revenge Porn". Or that Gawker and their attorneys ego's were so sky high they thought they could go in, take an L and a small payout because it's well known Hulk Hogan is a D-List faded celebrity and pretty terrible human being that the Jury wouldn't have much sympathy for.

To get absolutely raked over the coals for $115 million damages and never mind the punitive costs then have to pay up a $50 million bond to appeal. Gawker could pay for cheaper legal reps and they would be better than the ones they have.

The one Gawker editor who said he'd publish a child sex tape needs to get an especially hard kick in the ass. The guy did not know what he was even saying.

- "No younger than 4 years old."

The guy obviously thought, "yeah, I would be transgressive enough to do this one", without realizing that he just said he'd publish child pornography. How incredibly stupid do you have to be... I bet their lawyer wanted to throttle him.

Back in 2012, to the largely young and metropolitan audience of Gawker, and to those who found the story through news reports and search engines, the post was not particularly offensive. It was their choice to click on the headline and the play button. But the climate has changed since Kim Kardashian and Paris Hilton made their names with celebrity sex tapes; they seem like artifacts from an earlier and more licentious internet era.

So am I following this: The real story is Hogan being a racist, not his sex tape. Which is why we published the sex part of the tape ?

It's still up after being posted a few hours ago. So Gawker's legal representation must have fled the scene as any sensible legal team lodging an appeal wouldn't have let Nick Denton anywhere near a publishing platform till the appeal goes through
