Just so we're clear what was said is technically true, just misleading. In 48 states it is not forbidden to try for a temporary insanity defense due to 'trans panic' basically the fact that someone was trans somehow made you so cray-cray that you didn't understand what you were doing. Like all temporary insanity pleas it gets nowhere. What this does not mean is that there is an exception on the books for the murder of trans people. It's not something like say the self-defense exception.
Now California and Illinois both have laws on the books that specifically prohibit even bringing up temporary insanity by trans panic. That's the only difference.
Either way, these cases aren't common. I can't find specific numbers for how often the panic defense was used overall. But insanity dfenses ingeneral are very rare. They are used in about 1% of cases and succeed only about 25% of the time. And remember, those aren't just temporary insanity cases, those are cases where the defense is full on insanity. Not to mention, nowadays being found not guilty by reason of insanity is no picnic either. You are in an asylum possibly forever, but at least until the state considers you ok to leave. And if you have a muder rap, that is not likely at all.
