For anyone wondering why these people agreed to settle with Avellone for that high of figure, it's because in a settlement you get to negotiate how much you pay, if they lost in court (and if they agreed to a deal for this much money they clearly were going to get fucking vaporized in court or they're idiots with idiot lawyers) you don't get to negotiate how much in damages you pay and you have all the court costs for at minimum yourself.

Also because I forgot to respond to this:

Doesn't dismissed with prejudice actually mean they can't bring it again?
The 'prejudice' meaning that it has now officially been ruled on in a court of law and dismissed, not that the judge is adding an extra "and by the way fuck you" to the dismissal (although it kinda sorta does mean that).
Dismissed without prejudice is a 'too weak to stand up' claim, or missing paperwork or whatever, and they would be free to try again if they wanted. With Prejudice means its been ruled on and they would have to have sufficient grounds to overthrow the previous judges ruling that there was no case to answer, ie that the defendant is not guilty.

Also yeah, court mandated arbitrage is as lawfully binding as judicial mandate.

Well, yes. But the mere fact that he brought the case again tells us it wasn't dismissed with prejudice and in general I would not expect a case like this to get dismissed with prejudice if it never even went to trial because it got anti-SLAPPed when would the judge have evaluated the facts? I think it's much more likely he was effectively told he had a bad case at the time when he was being dismisssed and he came back with more evidence. I would have to look into it to know why he changed where he filed. (It may have just been to avoid the same judge for all I know.)

Breaking client confidentiality, eh, it is possible Avellone gave permission for the attorney to say that to Forbes, and it would be on Avellone to pursue a complaint, so honestly no big.

Breaking settlement confidentiality, depending on the actual terms of the settlement and/or the court, could scuttle the entire thing. It definitely opens the lawyer up to sanctions regardless, and would be a huge mistake for a practicing attorney to make.

You're making the same deductive leap many other people are making in this thread, and you cannot do that in this situation. There is some specific legal reason that the statement does not come straight out and say "the seven-figure payment is to Chris Avellone". We do not know the reason for that omission, but that omission is there for a purpose because otherwise the statement would have said that flat out. Every other portion of the statement is concrete except the part about the payment. Why? No clue. I've said several times now that it is a relatively safe assumption that the payment was to Avellone. But absent independent confirmation of that outside of Kain's account, we cannot say for sure that is the result.

And if you look at the settlement agreement, it does not say who the payment was made to! The the payment could actually be to the defendants/his accusers! The trade would certainly make more sense. The defendants lose face but get a lot of money for it. This also would remove the stress and years involved of litigation in their life. On Avellone's side, a low 7 figure sum might be a cheap price to pay for being able to re-enter the games industry, which (right or wrong) only has a hope of happening with the defendant's support..

The investigation and prosecution rates are abysmal, law enforcement tends to be terrible from beginning (remember all the rape backlogs) to end, etc.

So all we end up having is pitchforks and kangaroo courts on both sides since the powers that be don't take these things seriously in either direction
