It's the same reason statutory rape laws exist at all.

It is reasonable to assume that a young person isn't the best at making the right decisions for themselves. Young people make dumb mistakes all the time.

The age we use for statutory rape is completely arbitrary and a person being "legal" doesn't mean that they, individually, as a person, are now actually mature. Just that they're legally mature.

Preying on a young person, when knowing they may very likely be making a poor decision for themselves is a bad thing to do, regardless of if it's legal or not legal. Taking advantage of someones naivety is a wrong thing to do.

If James Franco had put forth some kind of reasonable effort to see if she really understood the implications of random sex with a celebrity might be, and could reasonably believe that "Hey, she knows all the risks and is still willing" than there is absolutely nothing wrong with it and they should do whatever they want.

It's not unreasonable to expect she might be naive or uninformed because most young people are naive or uninformed. If she's 18, Franco doesn't legally have to do anything, but the law isn't a rule of morality and just because he doesn't have to doesn't mean that he shouldn't.

James Franco is allowed to have sex with whoever he chooses too, as long as the person he's going to have sex with fully understands the consequences of the decision their making.

If he has reason to believe that they don't fully understand the risks, he should at least put forth some effort to ensure the person is making the right choice for themselves.
