Regarding the posts on the last page I want to note one thing about 1976 since it got mentioned a few times in relation to being an election in the wake of the handful of times we actually had a President facing impeachment. Reagan would have been the candidate had Nixon not been impeached/resigned. So arguably it could have provided the GOP with an even better "clean break." Ford wouldn't have even been in the running, he nearly didn't run in 1976, in part because upon taking the Presidency from Nixon he said he didn't intend to run. He was talked into "stopping Reagan" by VP Rockefeller and others.

In retrospect, Reagan freed from supporting the President seems like an obvious bad thing for the Democrats, but Reagan in 1976 was not Reagan in the 1980s, nor was Jimmy Carter. Of course, neither was Ford. They came out of their conventions with Carter up by like 30 some points, Ford came all the way back like he was LeBron in 2016 until he flubbed it up at the last second. Democrats seriously believed in late 1976 that they were going to face what happened in 1980 (lose the Senate as well) and that's part of one reason Carter came to DC with basically nobody on his side. The Party had seriously considered finding a way to dump him and then did the 2016 Trump move where nobody will openly say they support him and that they're focusing on their own races. Carter did not help by coming to DC saying he would be his own Chief of Staff and also thinking that the President operated like the Governor of Georgia and that he could order Congress to do his bidding.

"Kamala is a cop!" is probably our least favorite criticism of Senator Harris. Harris was never even technically a cop. She didn't run around in a leather jacket, waving a gun, and shouting, "You're under arrest, sugar!" Harris was a criminal prosecutor. Sister had herself an office and everything. You'd think after an (ALLEGED) criminal president, a president with a track record of actually enforcing the law would be a welcome change.

But no, America is stupid right now, so Harris had to literally explain this weekend why a former district attorney is a good fit to "faithfully execute" the nation's laws as president. She laid down the law during a speech to the South Carolina NAACP, and this is how the press chose to cover her speech.

Wait -- is Harris on trial here? Why is she "defending her record"? Did she lose all her cases like the prosecutor who faced off against Perry Mason each week? That guy needed to explain himself. Harris put assholes in prison. She imprisoned assholes so well she was the first woman elected district attorney of San Francisco and the first black woman to become attorney general of California. She's the Serena Williams of law and order. Beto O'Rourke needs to defend losing somehow to Ted Cruz. Joe Biden needs to defend not realizing women were people until late last week. But Kamala doesn't need to defend herself.

Is Bernie Sanders Finished?

At least a dozen Democratic presidential candidates have plausible paths to the nomination. Maybe more than that. And after the 2016 election, I’m not counting anyone out. That said: I think it’s starting to sink in that Senator Bernie Sanders is right at the fringes of plausibility. At best.

That’s what I’m seeing from the mainstream media, some liberal bloggers and sophisticated polling analysis. Recent Iowa polls show Sanders at about 15%, essentially in a three-person race for second place with Senator Elizabeth Warren and South Bend Mayor Pete Buttigieg. That’s for a candidate who won half the vote there in 2016.

And while Sanders is faring somewhat better nationally, that’s mainly because almost all the other candidates remain unknown to voters. As Nate Silver points out, only about 8% of Democrats say they’re definitely supporting Sanders. In other words, it’s entirely plausible that Sanders could fail to reach the delegate threshold in Iowa, Nevada, and South Carolina (and possibly New Hampshire). Even if he stayed in, he probably wouldn’t be much of a factor.

In short, it was clear at the time that a lot of Sanders votes were protest votes, and everything so far in 2020 confirms that he simply doesn’t have that many dedicated supporters.

It’s worth noting, too, that Sanders really hasn’t expanded his support among party actors. He’s in sixth place in endorsements so far. At least this time around he has Vermont’s politicians in his corner, but he has the backing of only a single member of Congress from the rest of the U.S.

I think when it comes to the most liberal voters, Noah Berlatsky has it right: “There’s nothing wrong with Sanders. It’s just becoming increasingly clear that, for the 2020 primary electorate, there isn’t anything overwhelmingly right with him either.”

Cass agreed. In a roundabout way, she even believed this would bring some justice for the rape she’d endured. Though Mueller was in the process of investigating whether the Trump campaign had colluded with Russia, money and love — not politics — seemed to be Cass’ motivation: She says she isn’t aligned with a specific party, describing herself as a “conservative liberal.”

Cass’ old friend B says “Cohen” reached out to ask if he could use B’s name in a document “to confirm certain allegations… he wouldn’t tell me what they were.” Once he sent her an “affidavit” with fake details about her friend being raped by Mueller, “I was like, ‘I want no part of this,’” B says. She warned Cass to break ties with “Cohen.” Cass didn’t listen.

In Cass’ telling, “Cohen” said they were just using her and B’s real names in the document as a placeholder; they would soon set up a covert identity for her. “I don’t think Carolyne really understood what was happening,” B says, “because he made her believe that he was trustworthy and cared for her. I think she felt romanced by him.”

Despite “Cohen’s” iffy promises of anonymity and the fact that he refused to pay her up front, he persuaded Cass to fly with him to Washington. At first, she says, “Cohen” told her she was just traveling to meet Burkman. Then “that turned last minute into, ‘No, it’s going to be a press conference,’” Cass says. If things went south, she reasoned, “I could always bail on them at any point.”

Leading up to the trip, Cass prepared as if for an acting gig, styling her clothes and rehearsing lines. On October 30, she rang in her 34th birthday. That day, a story popped up on her news feed that mentioned Burkman, someone named Jacob Wohl, and a mystery woman who was going to accuse Mueller of assault. Cass asked “Cohen” about this Jacob Wohl person: “He said, ‘I don’t know what you’re talking about,’” Cass says.

That was apparently enough to convince Cass to stay the course. The next day, “Cohen” picked her up around 4 a.m. and drove to LAX.

There, Wohl’s story quickly crumbled.

At the airport, “Cohen” asked Cass to take a selfie to prove to Burkman that they’d arrived; he’d repeatedly insinuated that the FBI might intercept them on their journey to Washington. A nervous Cass posed alongside him.

Though they made it through security and into the terminal without Cass seeing “Cohen” exchange his ID with the ticketing agents or security, they missed their flight. When they approached the airline counter to rebook, the agent assisting them pointed at Wohl and asked, “Jacob?”

He said yes.

“I said, ‘Who is this Jacob guy?’” Cass recalls. “He said, ‘Don’t worry, it’s just for today.’” Maybe this was all part of his efforts to evade the FBI, Cass reasoned. Plus, she’d been promised a secret alias, which “Cohen” said he’d set her up with soon. Perhaps “Jacob Wohl” was his.

But then, as they boarded the plane, “Cohen” lost all sense of discretion. He began checking his Twitter account… that is, Jacob Wohl’s Twitter account. Pretending to nap in her seat, Cass watched him log onto Instagram to check out girls in Halloween costumes. In previous conversations, he told her he wasn’t on social media. Yet, here he was, zooming in on photos of scantily clad women. “That was just the final straw,” Cass says.

Furious and frightened, Cass moved to an empty row of seats at the back of the plane, where she quietly cried. When they landed in Washington, she ducked the man she now believed was Jacob Wohl, rushed to the women’s bathroom, and called B, who told her to leave for New York City. She could stay at B’s apartment and ride out the impending storm.

As Cass hid in a stall, Wohl began calling incessantly and texting to ask if she’d been picked up by agents on her way to the bathroom. She knew she had to lure him out of the airport: She texted that she was waiting outside. She remained hidden until she got confirmation that he’d gone past security. After buying a spot on the next flight to New York City, she called Wohl and told him she was out.

On the phone, Wohl seemed wounded. He tried to convince her that they could skip their plans and go sightseeing instead. For once, Cass held fast and told him not to include her in his plans.

The next day, Wohl and Burkman went in front of a room of reporters and moved forward with the story, using Cass’ real name, details about her family, information about the trust fund officer who had embezzled from her, and lurid information about the supposed rape, including some details which mirrored her real experience. “Miss Cass’ accusation is in front of you,” Wohl told reporters that day. “It’s in voluminous detail and it checks out top to bottom.”

“I told them not to use my name, not to say anything about my family,” Cass says now. “If you need an actress to stand up there as Jane Doe, whatever. But if you think this can be, ‘I’m Carolyne Cass,’ you’re dead-ass wrong.”

The two kept in touch for months after the Mueller debacle. Looking back on the encounter, Cass has a hard time finding words for what made her want to stay by Wohl’s side, except that she felt desperate to believe that he was more like good-guy “Matthew Cohen” than Jacob Wohl; that despite the abundant evidence to the contrary, he did really care for her.

Schultz had been traveling the country to gauge interest among voters in his centrist independent candidacy.

Political watchers have noted that he had been absent from the campaign trail for weeks, raising questions about whether the billionaire had abandoned his presidential hopes.

In a statement released Wednesday, Schultz said he began experiencing back pain during a campaign stop in Arizona two months ago. The former Starbucks CEO said he has since had three back surgeries.

“Today, I am feeling much better, and my doctors foresee a full recovery so long as I rest and rehabilitate,” Schultz said. “I have decided to take the summer to do just that."

WASHINGTON, D.C. – Today, U.S. Senators Rand Paul (R-KY) and Ron Wyden (D-OR) introduced the Reforming Emergency Powers to Uphold the Balances and Limitations Inherent in the Constitution (REPUBLIC) Act, which will preserve the president’s ability to act immediately in cases of national emergencies but also uphold Congress’ constitutional responsibility to check the executive branch.
 
Current law provides the presidency with unilateral power to determine when and how it will exercise emergency powers. Although the Founders included the principle of the separation of powers as a central feature of our government, an emergency, such as a military invasion of the United States, can justify the suspension of the constitutional order so that the president can protect the nation immediately and without congressional authorization.
 
The REPUBLIC Act will continue to allow the president to take immediate action in necessary situations but also require expeditious and continual congressional review of declared national emergencies to ensure that the separation of powers is preserved.
 
“Congress fails its responsibilities to the American people and the Constitution when it leaves the executive virtually unchecked to unlock and exercise emergency powers in perpetuity. The REPUBLIC Act strengthens the separation of powers by instituting critical reforms, including requiring Congress to specifically approve of a national emergency declaration in a timely fashion instead of being forced to disapprove of an overreach by super majority, as well as preventing a president from taking over the internet and other means of communication. It does all this while preserving the president’s authority to act immediately to defend our nation,” said Senator Paul.
 
“Presidents have run roughshod over the Constitution for far too long because Congress keeps shirking its obligations. Checks and balances are more than pretty words on a page; they’re a bedrock principle of our Democracy. This legislation would reassert Congress’ role as a co-equal branch of government while preserving a President’s ability to address real emergencies,” said Senator Wyden.
 
Specifically, the REPUBLIC Act would:
 
    •    Permit the president to take emergency action for no more than 72 hours without congressional approval;
        ◦    Under current law, the burden is on Congress to pass a joint resolution of disapproval if it finds that a president has misused his authority to declare a national emergency.
        ◦    By imposing a requirement for approval, the REPUBLIC Act would empower the people’s representatives to combat misuse of presidential emergency powers.
    •    Establish expedited procedures by which Congress would consider a joint resolution of approval;
    •    Sunset congressionally approved national emergencies 90 days after the issuance of the presidential declaration, unless renewed;
    •    Exempt the president’s powers under the International Emergency Economic Powers Act (IEEPA) from the amendments made by this legislation to allow the president to immediately impose and sustain sanctions on our foreign adversaries. By carving out IEEPA, the REPUBLIC Act will not require Congress to vote every 90 days to continue sanctions on North Korea, Iran, transnational crime organizations, etc.;
    •    Repeal the statutory authority empowering a president to unilaterally control communications, such as the internet, cell phone service, and television/radio broadcasts; and
    •    Terminate all existing national emergencies that do not specify IEEPA as the source of presidential authority.
