I just don’t know that I’d argue Kotaku, which would have major legal implications in mishandling these calls if anyone chose to investigate this deeply, would claim important details backing their version of events if they don’t have such a recording to support their publication. It seems almost conspiratorial to imply Kotaku is lying about the recording, in print.
I like how the defense is Kotaku wouldn't lie because of legal liabilities, but Nathalie is somehow free of those exact same legal liabilities.
The only difference is Kotaku has a lawyer who will tell them publishing something without putting the liability on Nathalie is a problem. Now Nathalie does not want the liability, so Kotaku has taken it by publishing a rape accusation without a substantive quote from the alleged victim. Where's Kotaku's lawyer?
If this was a criminal matter, this liability would not exist since it be a factual matter of public record. Instead it's just a show for fun.
